1. What is PIP? PIP is Personal Injury Protection insurance coverage, also known as “no fault” coverage. It provides insurance benefits for medical treatment, lost wages, transportation, prescription medications and lost services to persons injured in a motor vehicle accident.

2. How do I know if I have PIP coverage? Florida law requires people who own and operate a motor vehicle in Florida to maintain this coverage. The declarations page of your insurance policy will show you in most cases how much coverage you have.

3. What benefits are available under PIP? PIP pays 80% of all reasonable and necessary medical expenses that arise out of the use, operation or maintenance of a motor vehicle. This includes medical, surgical, dental, x-ray or other diagnostic services, as well as hospital, ambulance and nursing expenses.
PIP also pays 60% of any loss of gross income or earning capacity caused by an inability to work due to injury. It also pays for expenses reasonably incurred in obtaining services from others that would have been performed by the injured person.
PIP also pays transportation costs incurred by injured parties traveling to and from locations where medical treatment is received.Finally, PIP pays death benefits of $5,000 per individual.

4. What if the accident was my fault? PIP benefits are paid regardless of fault.

5. Who else is covered under my policy? The named insured (person in whose name the policy is issued) is covered as well as all relatives living in the same household. Persons driving the insured vehicle, passengers and pedestrians may also be covered.

6. I’ve received a letter from my insurance company informing me of an “Independent Medical Examination” by another doctor. What should do? Under Florida law, PIP benefits cannot be terminated unless the insurance company receives a report from another doctor licensed in the same profession as your doctor which states that treatment is not reasonable, necessary, or related to your accident. More often than not, treatment is curtailed after such an exam. Your policy requires you to attend the exam or risk having your benefits terminated. Contact us for advice on your situation.

7. My insurance company has refused to pay for any more treatment. What can I do?This is exactly the type of case that we handle. In many cases, we can bring an action against the insurance company and have your benefits reinstated and your doctors paid.

8. What does this cost?Nothing. We handle PIP cases on a contingent fee basis. If we are successful in obtaining your benefits, the insurance company will pay our fees. If we do not obtain your benefits, you will not be charged. Either way, you will never receive a bill from our office.

9. I’m a medical provider.
